National Origin Discrimination
Under federal and New York State law, it is illegal for an employer or another person in the workplace to harass or take any negative actions against you because of your national origin. “National origin” can include a person’s ancestry, birthplace, cultural characteristics or linguistic characteristics.
Title VII of the Civil Rights Act of 1964, the Immigration Reform and Control Act of 1986, and the Civil Rights Act of 1866 are the federal laws that make discrimination based on national origin illegal. The New York State Human Rights law also prohibits discrimination against employees because of their national origin.
Legal Help for Employees
An employee or potential employee who has been discriminated against because of national origin may file a complaint with the employer, which may put a stop to the harassment. If the unlawful discrimination continues, the employer is liable and you may be able to sue the employer under state or federal law. However, you should always consult with an attorney, wherever possible, before making a complaint to your employer, because once you do so, you may be committing yourself to certain positions. You may also be putting yourself in a position where your employer might retaliate against you for making the complaint. This doesn’t mean you shouldn’t complain, but it does mean that you should get legal advice before making your complaint. You can always consult with the Law Offices of William Cafaro to get some guidance before you begin navigating what might be tricky waters.
Legal remedies for the employee may include lost wages and other damages. If you were terminated because of national origin, your job may be reinstated.
If you are subject to unlawful discrimination, it is important to take action as soon as possible to protect your legal rights. Federal and state laws set limits on the time you have to file discrimination claims. If you fail to lodge a claim within the time specified by law, you could lose your right to recover damages forever, even if you had good grounds for a claim.
